Terms of Service

1. Acceptance of Terms

Welcome to Drawn TCG (the "Service"), operated by Francisco Garreta Calderón, based in Spain (the "Operator", "we", "us").

By creating an account or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and the Operator.

2. Eligibility & Account Registration

You must be at least 16 years of age to use the Service. By registering, you confirm you meet this requirement.
One account per person. Account credentials are personal and non-transferable.
You are responsible for all activity under your account. Keep your password secure.
You must provide accurate registration information. We may suspend accounts with false information.

3. The Service

Drawn TCG is a free-to-play digital collectible card game featuring gacha (randomized pack opening) mechanics.

All gameplay content (cards, packs, in-game currency) is earned through gameplay. It is never purchasable with real money.
Gacha/pack odds are publicly disclosed in the app via the "View Rates" feature.
All pack openings are subject to our provably fair cryptographic verification system, allowing you to independently verify the integrity of your results.
The Service is provided "as available." We may schedule maintenance or updates that temporarily interrupt availability.

4. Acceptable Use & Player Conduct

You agree not to:

Harass, threaten, bully, stalk, or discriminate against other users in any way.
Cheat, hack, exploit bugs, use bots, scripts, mods, or manipulate game data.
Share, buy, sell, or boost accounts.
Spam, impersonate others, or share misleading content through any in-game feature.
Attempt to reverse-engineer, decompile, or extract source code from the Service.

Enforcement: Violations may result in warning, temporary suspension, or permanent ban depending on severity. Extreme violations (threats, illegal activity) may result in immediate permanent ban.

Content moderation (DSA Art. 17): When we restrict or remove content, or suspend or terminate an account, we will provide the affected user with a clear statement of reasons, the specific rule or term violated, and information about available remedies — including the right to appeal by contacting us. We aim to respond to appeals within 14 days.

5. Virtual Items & Gacha System

All virtual items (cards, packs, in-game currency, card backs) are licensed, not sold.
Virtual items have no real-world monetary value and cannot be exchanged for real money.
Items are non-transferable outside the game's built-in trading system.
We reserve the right to modify card statistics, abilities, and game balance to maintain fairness.
Belgium: Belgian gambling law (Belgian Gaming Act, articles 2/8/57) classifies paid randomized reward mechanics as gambling. Drawn does not sell packs or any random reward for real money — packs are earned exclusively through gameplay (sign-up gift, idle regeneration, daily login bonus, daily/weekly challenges, optional rewarded ads, and crafting from duplicates). The Belgian Gaming Commission's published position targets paid loot boxes; on the basis of the absence of consideration, we believe the current pack-opening mechanic falls outside that scope. If we ever introduce direct EUR-to-pack purchases or premium-currency-to-pack conversion, we will geo-block those features for Belgian residents and update this clause.

7. Rewarded Advertising

You may optionally watch advertisements to receive in-game rewards (packs).
Ads are served by Google AdSense / AdMob and are subject to their privacy policies.
Advertising cookies for Google AdSense / AdMob require separate consent managed via our cookie consent banner.
No advertisements are shown without your initiation.

8. Intellectual Property

All game content (card art, names, mechanics, UI, code) is owned by or licensed to the Operator.
You retain no intellectual property rights in any game content.
User-generated content (usernames, trade messages): you grant us a non-exclusive, worldwide license to display it within the Service.
Do not reproduce, distribute, or create derivative works from game content without written permission.

9. Account Suspension & Termination

We may suspend or terminate accounts for Terms violations.
You may delete your account at any time (subject to GDPR right to erasure).
Upon termination, access to all virtual items ceases. No refund is provided for earned items.
For cosmetic purchases: refund rights per Section 6 apply.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind.
We do not guarantee uninterrupted or error-free service.
We are not liable for loss of virtual items due to bugs, server issues, or account compromise (unless caused by our negligence).
Our maximum liability is limited to the amount paid by you in the 12 months preceding the claim (if any).
Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., death, personal injury, fraud, or mandatory consumer rights).

11. Governing Law & Disputes

These Terms are governed by the laws of Spain and the European Union.
EU consumers benefit from the mandatory rules of their country of residence. Nothing in this section overrides those mandatory consumer-protection protections (Article 6(2) Rome I Regulation).
Disputes: We encourage you to contact us first for informal resolution (30-day period). If unresolved, the competent courts of Spain shall have jurisdiction.
EU users may also use the EU Online Dispute Resolution platform.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated with 30 days' advance notice via email or in-app notification. Continued use after the notice period constitutes acceptance. If you disagree, you may delete your account before the changes take effect.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Operator regarding the use of the Service. No other agreements, representations, or warranties — whether oral or written — shall be binding unless expressly agreed in writing by the Operator.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, internet or telecommunications infrastructure failures, power outages, government actions, or third-party service provider failures.

16. Service Modifications

We reserve the right to modify, update, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. Material changes that significantly affect active users will be communicated with reasonable advance notice. We are not liable for any modification, suspension, or discontinuation of the Service or any part thereof.
